How the Probation Period Works in Denmark
The probation period (prøvetid) is a trial period at the start of employment where both you and your employer can end the arrangement with shorter notice. It’s common in Denmark — but it must be explicitly written in your contract to apply.
What is prøvetid?
A probation period gives both employer and employee a chance to evaluate the fit. During prøvetid, the employer can terminate your contract with just 14 days’ notice (instead of the usual 1–6 months). You can also resign with shorter notice during this time.
It only applies if explicitly stated in your employment contract. If there’s no written probation clause, normal notice periods apply from day one.
How long is it?
Under Funktionærloven, the maximum probation period is 3 months. Collective agreements may set different rules, but 3 months is the most common. Some employers set shorter periods (1–2 months).
Your rights during probation
- Same salary and benefits as after probation — the trial period doesn’t mean reduced pay.
- Same holiday accrual — you earn 2.08 days/month from day one.
- Same sick leave rights — you can call in sick during probation.
- Pension contributions — some employers delay pension until after probation. Check your contract.
Being fired during probation
Your employer can terminate with 14 days’ notice during the first 3 months. They don’t need to give as detailed a reason as after probation, but the dismissal still cannot be discriminatory. Common reasons: performance doesn’t meet expectations, poor cultural fit, or role becomes redundant.
The 14-day notice must be given before the probation period ends. If the employer misses this window, normal notice periods (1 month minimum) apply.
Sick leave during probation
You have full sick leave rights from day one. However, extended absence during probation is a common reason employers terminate — they’re legally allowed to consider attendance when evaluating fit. Get a doctor’s note for any absence longer than a day or two to protect yourself.

Can I resign during probation?
Yes. Your notice period during probation is typically 14 days (same as the employer), unless your contract specifies otherwise.
What if my contract doesn’t mention probation?
Then there is no probation. Normal Funktionærloven notice periods apply from your first day — 1 month notice from the employer, 1 month from you.
Is probation the same for all jobs?
Funktionærloven covers most salaried/office roles. For hourly, manual, and other roles, probation terms are set by collective agreement or individual contract. Always read your contract carefully.
Can probation be extended?
Under Funktionærloven, the maximum is 3 months. It cannot be extended. If the employer hasn’t decided by month 3, you automatically transition to normal employment terms.
